Couple arrested outside of Lincoln familiar to local authorities

As the legalization of marijuana has occurred in several states, confusion has also arisen over how its possession and/or sale is treated legally across the country. Those living in states where recreational use of cannabis is allowed may not understand that transporting it into states where it is not could result in criminal penalties. In such a case, ignorance regarding local state laws may not stand up as a sufficient argument. 

The case of the elderly couple looking to give 60 pounds of marijuana away as Christmas gifts in Vermont has been detailed on this blog before. The couple was originally arrested days before Christmas in York County. Subsequent events now have them facing new legal troubles. In early January, law enforcement officials stopped them outside of Lincoln for tailgating. Their behavior prompted the officers involved to suspect they were up to something. A drug-sniffing dog was called in, and a duffle bag containing $18,000 (as well as trace amounts of marijuana) was found in their trunk. This led authorities to arrest them for suspicion of carrying drug money. 

Given that the couple involved in this case was from California (where marijuana can be used recreationally), it may be easy to understand their confusion over their arrest. Few likely are familiar with the drug laws of each individual state. While many may question the motives of one transporting a significant amount of cannabis (as well as other items that authorities may link to drug-related activity), it should be remembered that he or she is entitled to present his or her reasons (which he or she may view to be perfectly valid) in court.
